Please read these Terms and Conditions carefully before using Der Die Fox (the "App"), operated by Pikandi ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the App.

2. Description of Service

Der Die Fox is a language-learning application designed to help users practice German vocabulary and articles (der, die, das). The App may include features such as:

  • Flashcards and spaced repetition exercises
  • AI-generated vocabulary decks and learning content
  • Photo-based object recognition for vocabulary practice
  • Speaking and listening exercises
  • Regional vocabulary for Germany, Austria, and Switzerland
  • Premium subscription features

We may add, modify, or remove features at any time to improve the App.

3. Eligibility

  • You must be at least 13 years old to use the App.
  • If you are under 18, you confirm that you have permission from a parent or legal guardian.
  • You are responsible for ensuring that use of the App is permitted in your country or region.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials secure and confidential
  • Notify us promptly of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

5. Subscriptions and Payments

Some features of the App may require a paid subscription.

  • Subscriptions are processed through the Apple App Store or Google Play Store, depending on your device.
  • Payment, billing, renewal, cancellation, and refunds are governed by the applicable store's terms and policies.
  • Subscription fees are charged at the rates displayed at the time of purchase.
  • Subscriptions may renew automatically unless cancelled before the renewal date through your store account settings.
  • We do not guarantee uninterrupted access to premium features and may change subscription offerings over time.

6. User Content and Conduct

You may upload or submit content such as photos, text inputs, corrections, or feedback ("User Content"). You agree that you will not:

  • Upload content that is illegal, harmful, offensive, or infringes the rights of others
  • Upload content containing personal data of others without permission
  • Attempt to reverse engineer, disrupt, or misuse the App or its services
  • Use the App for any unlawful or unauthorized purpose
  • Use automated systems to access the App without our permission

You retain ownership of your User Content. By submitting User Content, you grant us a limited license to process, store, and use it solely to provide and improve the App's features, in accordance with our Privacy Policy.

7. Intellectual Property

All content in the App — including software, design, text, graphics, logos, and learning materials — is owned by Pikandi or its licensors and is protected by intellectual property laws.

  • You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial learning purposes.
  • You may not copy, modify, distribute, sell, or create derivative works from the App or its content without our written consent.

8. AI and Educational Disclaimer

The App uses automated and AI-powered tools to generate learning content, analyze images, and provide language suggestions. You acknowledge that:

  • AI-generated content may contain errors, including incorrect articles, translations, or vocabulary
  • The App is an educational aid and does not replace formal language instruction or professional certification
  • We do not guarantee specific learning outcomes, exam results, or fluency levels
  • You should verify important language information through additional sources when needed

9. Third-Party Services

The App may integrate with third-party services such as cloud hosting, authentication providers, analytics, AI processing, and app store billing platforms. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services outside our reasonable control.

10. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. Upon termination, your right to use the App ends immediately. Provisions that by their nature should survive termination will remain in effect.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure at all times.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Pikandi and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the App.

Our total liability for any claim relating to the App shall not exceed the amount you paid us for the App or subscription in the twelve (12) months before the event giving rise to the claim, or zero if no payment was made.

13. Changes to These Terms

  • We may update these Terms from time to time.
  • Material changes will be posted within the App or on our website.
  • Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable laws, without regard to conflict-of-law principles. If you are a consumer in the European Union, you may also benefit from mandatory protections under the laws of your country of residence.
